General terms & conditions

1. GENERAL TERMS & CONDITIONS FOR BOOKING PRIVATE PROPERTIES (hereinafter “Terms”)

SUNČANA STRANA d.o.o. (in English: Bright Side Ltd.) is a Property Owner of two villas: 1) Luxury Villa Florio and 2) Luxury Villa Axel, and a company registered for tourism-related services.
These Terms are applicable for the bookings made to the named accommodation.
These Terms incorporate the conditions below and are applicable to both SUNČANA STRANA d.o.o. and the guests with confirmed bookings.

2. BOOKING AND PAYMENT

Bookings are to be made by persons 18 years old and above.
Bookings are to be made by one Lead Guest for all other co-guests that are coming with him/her.
Bookings are considered confirmed once the payment has been made and the Lead Guest has received a booking confirmation by the official SUNČANA STRANA d.o.o. email.
The Lead Guest must be at least 18 years of age and must be authorized to make the booking, on the basis of these booking conditions, on behalf of other co-guests named in the specific booking.
SUNČANA STRANA d.o.o. is not liable and cannot be held accountable for any disputes and disagreements between the Lead Guest and the accompanying co-guests, with regards to their visit and payment arrangements. In other words, the Lead Guest is solely responsible to SUNČANA STRANA d.o.o. and to other co-guests for any unauthorized actions on their behalf.
The Lead Guest is solely responsible to make the payment for the booking in accordance with the payment policy to SUNČANA STRANA d.o.o. and cannot waive or transfer that responsibility.
Payments can be made by bank transfer only, at the account of Suncana Strana d.o.o., provided in the booking process.
The general payment policy is such that the guest pays a 30% deposit, in advance, alongside making the booking, and 70% of the rest of the total price at least 30 days prior to arrival.
The first payment (30%) is not refundable, and it is for ensuring the reservation of the dates (bookings).
If the second payment (70%) is not paid within the above-mentioned timeframe, the first payment (30%) will be lost, and the booking will be automatically canceled.
The receiving of the deposit payment will be confirmed with a booking confirmation, while an invoice will be issued at the end of the stay and will state the total amount.
SUNČANA STRANA d.o.o. reserves the right to refuse the guest to make a booking without stating any reason.

3. CONTRACT

The short-term rental contract is considered to be signed between the Lead Guest and Suncana Strana d.o.o., based on the provisions included in the Terms.
These Terms shall be governed by, construed, and enforced in accordance with the laws of Croatia and shall be binding upon the parties worldwide.
All disputes are to be resolved with Croatian courts.

4. PRICES

The prices for booking the accommodation are based on the period of the season that is being booked.
The price of accommodation is subject to a surcharge for any extras if they are not included in the initial price which is to be noted by SUNČANA STRANA d.o.o. at the time of booking creation.
In all cases, and in conditions prescribed by the Terms, SUNČANA STRANA d.o.o. shall only accept cancellations made by the lead guest.

5. SECURITY DEPOSIT

A security deposit of €500 is required to cover the cost of any potential damages made by the guests at the accommodation units and in their surroundings.

The security deposit will be authorized on the guest's credit card one week prior to arrival, and it will not be charged unless there is any damage or violation of our house rules during the stay. The authorization will be released no more than 10 working days after the checkout, returning the funds to the same credit card used for the initial authorization.

Please note that SUNČANA STRANA d.o.o. reserves the right not to accept guests if the security deposit is not provided in the form of a valid credit card authorization.

6. BOOKING MODIFICATION BY THE GUEST

All modifications of the number of guests or property changes or date changes must be confirmed by Suncana Strana d.o.o.
SUNČANA STRANA d.o.o. reserves the right not to accept any booking modification made by the guest.

7. CANCELLATION

No free cancellation is allowed, and special conditions apply:
1. In case the booking is canceled less than 1 month prior to arrival (30 days), the remaining total booking cost will be charged as a cancellation fee.
2. No Show policy: 100% of the booking will be charged as a penalty fee.
3. Early Departure policy: 100% of the remaining booking cost will be charged as a penalty fee.
4. Noncompletion of the second payment (70%) on time may result in cancellation of the booking and the first payment (30%) will be charged as a cancellation fee.
5. Security Deposit is fully refundable after inspection of the property.
6. The Security Deposit will be refunded to the customer provided that no damage has been found to the property, furniture, and/or existing equipment in the property.

8. BOOKING MODIFICATIONS AND CANCELLATIONS MADE BY SUNCANA STRANA D.O.O.

In the event that the cancellation or modification has been made by Suncana Strana d.o.o., it commits to provide the guests with accommodation of the same or better quality.
If no alternative accommodation is available or acceptable to the guest, SUNČANA STRANA d.o.o. shall refund the guest the full amount paid for the booking.

9. COMPLAINTS

All guest complaints about accommodation or property owner must be submitted in writing to Suncana Strana d.o.o., via an official email address, no later than 1 day after learning about the complaint reason.
Suncana Strana d.o.o., to the best of its ability, shall act promptly to resolve any issues raised by the guest.
Failure to alert SUNČANA STRANA d.o.o. in accordance with the above provision will lead to the rejection of the guest’s complaint.

10. ARRIVAL AND DEPARTURE

Check-in: after 16:00
Check-out: before 10:00

11. TRAVEL

The Lead Guest is responsible for other co-guests taking with them correct travel documentation (passports and visas, driving licenses, vehicle registration, green card, motor insurance etc.).
SUNČANA STRANA d.o.o. shall not be held responsible for any problems arising as a result of non-confirmation of guest travel arrangements e.g. plane tickets, car hire, transfers etc.

12. GUEST RESPONSIBILITIES

The guests must keep the property and all furniture, fittings, effects, facilities, equipment, and grounds in the same state and condition as at the commencement of the booking, and in the same state of cleanliness and general order in which it was found.
The guest is solely responsible for any breakages, loss, or damage to the property.
SUNČANA STRANA d.o.o. reserves the right to make deductions from the security deposit for any extra cleaning over the number of hours committed to cleaning and to claim compensation for costs over and above the sum of the security deposit.
The parking of caravans/pitching of tents is strictly forbidden and is a reason for the guest to be expelled from the property without prior notice.
Smoking is forbidden indoors. A cleaning fine of € 250 may be applied.
Smoking is allowed outside but must be done in a safe manner. Finished cigarettes should not be thrown into the garden and the fire risk should be considered at all times.
Cleaning fees will apply in case finished cigarettes are found outside the available ashtrays.
The guests shall abide by any other responsibilities prescribed by the Terms related to their behavior whilst at the property.

13. NUMBER OF PEOPLE USING THE PROPERTY

Luxury Villa Florio can accommodate up to 10 guests.
Luxury Villa Axel can accommodate up to 8 guests.
The maximum number of persons using the property must be honored by the guests at all times.
Only those persons named at the time of booking may use the property without prior agreement.
SUNČANA STRANA d.o.o. reserves the right to terminate the booking without prior notice and without refund if the numbers are exceeded.

14. ADDITIONAL SERVICES

For any additional services, the guest must inform SUNČANA STRANA d.o.o. no later than 28 days prior to arrival, or in cases of late bookings, 48h after booking creation.
Prices and payments for such services are to be agreed upon between SUNČANA STRANA d.o.o. and the lead guest.

15. LINEN & CLEANING

Villas are equipped with linen and towels.
Both linen and towels will be changed every seven days.
Upon request and upon availability a mid-week cleaning service could be booked upfront.

16. SWIMMING POOLS

Swimming pools are open and heated throughout the renting season, however, SUNČANA STRANA d.o.o. cannot guarantee a minimum temperature as this is dependent on the weather conditions.
The pool shall be used at the guests’ own risk and children must be accompanied by an adult at all times.
Pool policies: No diving. No glassware. No drink & swim. No peeing in the pool.

17. SOCIAL EVENTS AND OTHER FUNCTIONS

Any private events (e.g. party, wedding, cocktail party) at the property that the guest wants to organize must be pre-approved by Suncana Strana d.o.o.
Additional charges and/or increased security deposits may be applicable, and the amount is set at the discretion of Suncana Strana d.o.o.

18. SECURITY AND VALUABLES

Any valuables left at the property by the guest are left at the guest’s own risk.
SUNČANA STRANA d.o.o. is not responsible for any loss of private belongings that may occur to the guest.
No refund can be given should the guests decide to vacate the property as a consequence of a burglary.

19. PETS

No pets/animals are allowed at the property.
The unannounced arrival with a pet/animal may be a reason for a refusal of the guest by SUNČANA STRANA d.o.o. and the right to refund expires.

20. LIABILITY

SUNČANA STRANA d.o.o. shall not be liable for the death of, or personal injury of any member of a booking party, or of any other person at the property.
SUNČANA STRANA d.o.o. shall not be liable for any loss, breach or delay due to any cause beyond its reasonable control, including though not limited to acts of God, explosion, tempest, fire or accident, war or threat of war, civil disturbances, acts, restrictions, regulations, bylaws or measures of any kind on the part of the government or local authority, strikes, lockouts or other industrial actions or disputes or adverse weather conditions.
In any mentioned case SUNČANA STRANA d.o.o. is entitled to treat the booking as discharged.
In the event of discharge, the liability shall be limited to the return of the sums paid to us in respect of the unused portion of the rental calculated on a pro-rate daily basis, deducted by an administrative fee of 50 Euro to cover the reasonable expenses.
SUNČANA STRANA d.o.o. shall not be liable for the failure of public utilities such as water, gas, and electricity.
In case of breakdown of mechanical equipment such as pumps, boilers, swimming pool filtration systems, and similar, the guest shall inform SUNČANA STRANA d.o.o. immediately and SUNČANA STRANA d.o.o. shall take measures for the recovery of such equipment as soon as possible.
SUNČANA STRANA d.o.o. shall not be liable for noise or disturbance originating beyond the boundaries of the property or which is beyond their control.
In the event that a source of noise has been in existence prior to the guest’s arrival and SUNČANA STRANA d.o.o. is informed, SUNČANA STRANA d.o.o. will contact the guest to inform them of the disturbance.
SUNČANA STRANA d.o.o. is not liable for events beyond its control e.g. bad weather including events arising as a result of very hot or unusual weather, delays caused by carrier companies, etc.

21. SPECIAL REQUESTS

Any special request by the guests shall be considered by Suncana Strana d.o.o., and it will inform the guests as soon as possible whether it is able to grant such requests.
SUNČANA STRANA d.o.o. shall not be held accountable in the case that it is not able to grant a special request made by the guests.
